Jobs Requiring Background Checks

Requirements:
Background checks are required for:
• Police officers
• Elderly care employees
• Public, private, intermediate units, and area vocational-technical schools employees.*
• Home care employees

*Beginning April 1, 2007, all prospective employees of public and private schools, intermediate units, and area vocational-technical schools must submit a criminal history check, credit check and a set of fingerprints with application for the purpose of a federal criminal history check, including, but not limited to: teachers, substitutes, janitors, cafeteria workers, independent contractors and their employees, bus drivers, and student teacher candidates. An exception is those employees and independent contractors who have no direct contact with children.

Restrictions on Asking Applicants about Arrests and Convictions

Arrests:
1. State law doesn't specifically restrict employers from asking applicants or employees about arrests.
2. The city of Philadelphia prohibits employers with 10 or more employees from inquiring about an applicant's criminal history until after the first interview. Employers should remove any such questions from their job application forms.
3. During a first interview, employers may not inquire about an applicant's criminal history unless the applicant voluntarily discloses the information, and then only the information disclosed may be discussed.
4. Employers may not require applicants to disclose information about arrests that did not lead to convictions.

Convictions:
1. Employers can only consider felony and misdemeanor convictions to the extent to which they relate to an applicant's suitability for employment in the position.
2. If an employer decides not to hire the applicant and that decision is based in whole or in part on the criminal history, the employer must notify the applicant in writing.

Reference Checking Regulations

Requirements and Protections:
State law provides immunity from civil liability to an employer for disclosing job performance information with respect to a current or former employee upon the request of an employer unless lack of good faith is demonstrated by clear and convincing evidence.

Blacklisting isn't specifically prohibited, but blacklisting former employee could constitute libel or slander.
